1. Acceptance of Terms

These Terms of Service (“Terms”) govern your access to and use of the Biohack mobile application, the website at buettnerlabs.com, and all related services (collectively, the “Service”) operated by Buettner Labs LLC (“Buettner Labs,” “we,” “us,” or “our”), a Wyoming limited liability company.

By creating an account, downloading the app, or otherwise accessing or using the Service, you agree to be bound by these Terms, our Privacy Policy, and our Disclaimer. If you do not agree to these Terms, you may not use the Service.

2. Description of Service

Biohack is a nutrition tracking application that provides food longevity scores, micronutrient tracking, AI-powered meal analysis, fasting tracking, and supplement recommendations based on publicly available nutritional data and general wellness research. The Service uses artificial intelligence to analyze meal inputs and generate informational scores and insights.

The Service is currently available in the United States, Canada, Australia, New Zealand, the United Kingdom, and Germany through the Apple App Store. We make no representations that the Service is appropriate or available for use in countries or regions other than those listed above.

3. Health and Medical Disclaimer

THE SERVICE IS NOT A MEDICAL DEVICE AND DOES NOT PROVIDE MEDICAL ADVICE.

The information provided by Biohack, including but not limited to food scores, nutrient analysis, fasting data, coaching suggestions, and supplement recommendations, is for general informational and educational purposes only. It is not intended as, and should not be construed as, medical advice, diagnosis, or treatment.

The Service is not intended to diagnose, treat, cure, or prevent any disease or health condition. Food scores and nutrition information are based on publicly available nutritional data, peer-reviewed research, and general wellness principles. Individual nutritional needs vary significantly based on age, sex, health conditions, medications, and other factors.

Always consult a qualified healthcare professional before making changes to your diet, supplement regimen, or fasting protocol, especially if you have any medical conditions, allergies, are pregnant or nursing, or are taking medication.

These statements have not been evaluated by the Food and Drug Administration. This product is not intended to diagnose, treat, cure, or prevent any disease.

4. Eligibility

You must be at least 18 years of age to use the Service. By creating an account or using the Service, you represent and warrant that you are at least 18 years old. If we learn that we have collected personal information from anyone under 18, we will delete that information promptly.

5. User Accounts

To access the Service, you must create an account using either your email address or Apple Sign-In. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

You may delete your account at any time through the Profile section in the app or by contacting us at info@buettnerlabs.com. Upon account deletion, your personal data will be permanently deleted within 30 days, except where retention is required by law.

6. Subscriptions, Free Trial, and Payment

6.1 What is free

You can create an account and log your first three meals without paying. After that, continued meal logging and the Service's paid features require an active subscription or trial.

6.2 Plans and prices

Biohack is offered as an auto-renewing subscription in a single subscription group:

Monthly: US$12.99 per month.
Annual: US$89.99 per year.

Prices are shown in US dollars for the United States storefront. In Canada, the United Kingdom, Germany, Australia, and New Zealand, Apple charges the equivalent local price according to its own pricing tiers, including any applicable VAT, GST, or sales tax. The exact price and currency that apply to you are always displayed by the App Store before you confirm the purchase, and that displayed price is the one that governs.

6.3 Free trial

New subscribers are offered a 14-day free trial. The trial is available once per Apple ID across the entire subscription group: if you have previously used a trial or held a subscription to Biohack, you are not eligible for another, and the App Store will charge you from the start.

Unless you cancel at least 24 hours before the trial ends, it converts automatically into a paid subscription at the price shown when you signed up. If you cancel during the trial, you keep access until the trial period ends and are not charged.

6.4 Automatic renewal and cancellation

Subscriptions renew automatically for the same period unless cancelled. Apple charges your account within 24 hours before the end of the current period. Renewal continues indefinitely until you cancel.

You cancel through Apple, not through us. Open iOS Settings, tap your name, then Subscriptions, select Biohack, and choose Cancel Subscription. Cancellation takes effect at the end of the current billing period; you keep full access until then. Deleting the app or deleting your Biohack account does not cancel your subscription. You must cancel it in the App Store.

6.5 Payment, refunds, and price changes

All purchases are processed by Apple as the merchant of record. We never receive or store your payment card details. Because Apple is the seller, refunds are handled by Apple and are governed by Apple's Media Services Terms and Conditions. You can request a refund at reportaproblem.apple.com. We have no ability to issue refunds for App Store purchases, though we will gladly help you with a request. write to us at info@buettnerlabs.com.

If we change subscription prices, the change will not affect your current billing period. Apple will notify you and, where required, ask for your consent before any increased price is charged; if you do not agree, you can cancel before the change takes effect.

6.6 Statutory consumer rights

Nothing in this section limits any rights you have under the consumer law of your country, which apply in addition to the above:

European Union and United Kingdom: you generally have a 14-day right to withdraw from a distance contract for digital services. Because Apple is the seller, that right is exercised against Apple under its Media Services Terms; note that where you ask for the service to begin immediately and acknowledge it, the withdrawal right may end once performance has started. Your statutory rights regarding non-conforming digital content are unaffected.
Australia: our services come with guarantees that cannot be excluded under the Australian Consumer Law, including a right to a remedy for a major failure and to compensation for reasonably foreseeable loss or damage. Nothing in these Terms excludes, restricts, or modifies those guarantees.
New Zealand: where you acquire the Service as a consumer, the Consumer Guarantees Act 1993 and the Fair Trading Act 1986 apply and are not excluded by these Terms.
Canada: provincial consumer protection legislation may give you additional rights, including in respect of automatically renewing contracts. Those rights are unaffected.
United States: some states give you additional rights in respect of automatically renewing subscriptions, including notice and cancellation requirements. Those rights are unaffected.

7. User Conduct

You agree not to:

Use the Service for any unlawful purpose or in violation of any applicable laws.
Attempt to gain unauthorized access to the Service, other accounts, or any related systems.
Interfere with or disrupt the Service or servers/networks connected to the Service.
Reverse engineer, decompile, or disassemble any part of the Service.
Use the Service to collect personal information of other users without consent.
Use automated means (bots, scrapers, etc.) to access the Service without our written permission.
Resell, redistribute, or commercially exploit any portion of the Service without our written permission.

8. Intellectual Property

The Service, including its content, features, functionality, design, text, graphics, logos, and software, is owned by Buettner Labs LLC and is protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

9. User Content

By submitting content to the Service (including meal photos, food descriptions, and feedback), you grant Buettner Labs a non-exclusive, worldwide, royalty-free license to use, process, and analyze that content to provide and improve the Service. You retain ownership of your content. Upon account deletion, your content will be deleted in accordance with our data retention practices described in the Privacy Policy.

10. AI-Generated Content

The Service uses artificial intelligence (including third-party AI services) to analyze meals, generate nutrition scores, provide coaching suggestions, and create other content. AI-generated content may contain errors or inaccuracies. You acknowledge that:

AI outputs are not reviewed by medical professionals or registered dietitians before being displayed.
You should not make health decisions based solely on AI-generated content.
AI models may produce different results for the same input at different times.
We do not guarantee the accuracy, completeness, or reliability of AI-generated content.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any defects will be corrected. We do not warrant the accuracy, completeness, or reliability of any nutritional data, scores, or recommendations provided through the Service.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BUETTNER LABS LLC, ITS OFFICERS, DIRECTORS, MEMBERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

YOU SPECIFICALLY ACKNOWLEDGE THAT BUETTNER LABS SHALL NOT BE LIABLE FOR ANY DAMAGES ARISING FROM YOUR RELIANCE ON ANY NUTRITIONAL INFORMATION, SCORES, COACHING SUGGESTIONS, OR RECOMMENDATIONS PROVIDED THROUGH THE SERVICE, INCLUDING BUT NOT LIMITED TO ANY ADVERSE HEALTH EFFECTS.

13. Indemnification

You agree to indemnify, defend, and hold harmless Buettner Labs LLC and its officers, directors, members, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your use of the Service, your violation of these Terms, or your reliance on information provided by the Service.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions. If you access the Service from outside the United States, you do so at your own initiative and are responsible for compliance with local laws to the extent they apply.

Informal Resolution: Before filing any formal legal action, you agree to first contact us at info@buettnerlabs.com and attempt to resolve the dispute informally for at least 30 days.

If informal resolution fails, any disputes arising from these Terms or the Service shall be resolved exclusively in the state or federal courts located in Sheridan County, Wyoming, and you consent to the personal jurisdiction of such courts.

Consumers. The two paragraphs above apply only to the extent the law allows. If you use the Service as a consumer, nothing in these Terms deprives you of the protection of the mandatory consumer law of the country where you live, and nothing prevents you from bringing proceedings in the courts of that country. Consumers in the European Union, the United Kingdom, Australia, New Zealand, and Canada keep every right their national or provincial law gives them, including the rights set out in Section 6.6, whatever this Section says about Wyoming law or Wyoming courts.

Consumers in the European Union may also use the European Commission's online dispute resolution platform at ec.europa.eu/consumers/odr. We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.

15. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page with a new “Last updated” date and, where appropriate, notifying you through the app. Your continued use of the Service after any changes constitutes acceptance of the modified Terms.

16. Termination

We may terminate or suspend your access to the Service at any time for violation of these Terms or for any other reason at our sole discretion, with or without notice. Upon termination, your right to use the Service will immediately cease. You may terminate your account at any time by using the delete account feature in the app or by contacting us.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

18. Entire Agreement

These Terms, together with the Privacy Policy and Disclaimer, constitute the entire agreement between you and Buettner Labs LLC regarding the Service and supersede all prior agreements.
